According to reports on the Web, Apple is being sued over the use of the name of its next Mac operating system, OS 9.

Microware Systems, a software manufacturer based in Iowa, has alleged that Apple has infringed the trademark of Microware’s Unix-based OS-9 operating system.

Mac OS 9 is scheduled to ship in October, according to Apple’s announcement at Macworld Expo, New York, in July.

Microware’s OS-9 operating system is aimed at the embedded market – running on devices such as TV set-top boxes – and there is a version that runs on PowerPC processors.

Microware’s suit was filed in the US District Court for the Southern District of Iowa. The company is seeking an injunction that would prevent Apple from using the OS 9 name in advertising and marketing campaigns, and is also asking for revenue from sales of the Mac OS 9.
