MP3.com is suing the Recording Industry Association of America (RIAA) accusing it of unfair business practices.

The suit is a counter attack on the RIAA, which filed a suit against MP3.com (see "MP3.com chief hits back")three weeks ago claiming the company had infringed copyrights held by record labels and artists.

MP3.com’s suit was filed in a San Diego court on Monday, and singles out the RIAA’s president and chief executive Hilary Rosen as engaging in unfair business practices.

Michael Robertson, chairman and CEO of MP3.com, said: "Since inception, MP3.com has faced the increasingly aggressive tactics of the RIAA and its leadership. We can no longer tolerate the bullying tactics of this not-for-profit trade association. After we get to the bottom of all their actions toward MP3.com, we will vigorously pursue all of our legal remedies."
